Terms and Conditons of Service
IISNet Networks ("IISNet Networks") will provide electronic services required for hosting a website to an individual or business ("Client").
These terms of service will take effect when the Client joins the hosting service of IISNet Networks. Henceforth, "we", "us" and "our" means IISNet Networks, the provider of this service, and "you" means the Client.
By submitting your order, or by hosting and uploading any data to our servers, you acknowledge that you have thoroughly read, and agreed to abide with this Terms of Service.
We have the right to deny service to any Client, for any reason whatsoever, that is deemed to be unsuitable for our servers. We also reserve the right to modify this Terms of Service without any notice whatsoever at our decision.
1. Content and Server Use
The content of the hosted site is the responsibility of the site owner alone, and not the responsibility of IISNet Networks. We have a zero-tolerance policy towards adult content, whether legal or not, any pornography, nudity or any obscene depictions whether in text or in pictures or photographs that may violate laws. We also do not allow any illegal "Warez" (pirated software), illegally ripped "MP3s", or anything else that is copyrighted, unless permission is given from the owner of the document. Links or content that provides information about any illegal activity is unacceptable and not allowed. Any content that is abusive, threatening, profane and vulgar are not allowed on the network. Hate and racism are strictly prohibited. Viruses, data corrupted by viruses, and Trojan Horses are also prohibited to be stored on our servers. Anything IRC related is strictly not allowed, including, but not limited to, web clients, or bots.
Inappropriate uses of email are also strictly prohibited. Examples of inappropriate usage includes, but is not limited to, spamming of any sort, UCE (Unsolicited Commercial Email), UBE (Unsolicited Bulk Email), passive spamming or "spamvertising" (promoting a site hosted with IISNet Networks by spamming from another server). Violations of our inappropriate email use policy may result in suspension or deletion of your account, and up to a $300 administration fee may be charged in severe instances. IISNet Networks reserves the rights to determine whether the emails sent are appropriate or inappropriate.
IISNet Networks retains the right to investigate any part of your account if approached by law enforcement, authorities or if we receive multiple reports of illegal or inappropriate activity originating from your account. If asked by law enforcement, IISNet Networks will provide the authorities with access to your account.
If any part of the TOS is broken, IISNet Networks reserves the rights to delete, nullify and refuse the member's account.
If we determine that any site on our servers is consuming too much of the server's resources (CPU usage, memory usage, system resources), we have the right to suspend the user's account without any notice. In order for the account to be reactivated, Client has to contact us to propose a plan to rectify this situation for our acceptance.
2. Indemnification
Client must agree to provide clear, accurate, and complete information about Client as required by IISNet Networks when signing up, and must keep it current at all times.
Client agrees to use all services and facilities provided by IISNet Networks at their own risk. In no event shall IISNet Networks be liable for any loss, loss of data, or any commercial damage, including but not limited to special, consequential, incidental, or any other damages. Client agrees to hold IISNet Networks harmless from any losses, costs, penalties, fines, demands, or liabilities, including legal and attorney fees that may have resulted from any service provided or will provide to Client.
3. Payment Policies
All accounts are setup on a prepaid basis. Full payment is required before any hosting services are issued. We reserve the right to modify the price at any time.
Prepayment is due every 30 days from the date that the account was first created, or every 365 days if the account is paid yearly. Billing will continue unless a cancellation request is received 5 days before your next billing date. Client will automatically be charged every 30 days if paying monthly, or every 365 days if paying yearly. This will continue unless Client cancels the account, and IISNet Networks has authorised the request.
Client also agrees to pay any extra charges that their accounts may incur, including but not limited to extra bandwidth usage, and extra disc space usage. All monetary transactions are in US Dollars.
4. Cancellation and Refunds
IISNet Networks reserves the right to terminate a Client's account without notification if the account violates the Terms of Service. No refund will be given. Within the first 30 days of account creation, Client is covered by a money-back guarantee. If Client cancels account within the first 30 days, a full refund will be made. After the first 30 days, Client can cancel their account at any time, however, no refund will be given.
5. SSH/Telnet Policy
IISNet Networks has a strict no SSH or Telnet without identification policy. We do not give out any SSH or Telnet access to our systems unless appropriate government issued identification is received by IISNet Networks. Accounts attempting to gain access to such services without proper identification on file will be immediately deactivated.
6. Scripts Policy
CGI scripts are allowed on our servers. By default, every account setup comes with a cgi-bin directory. You can use any script you like, as long as it is not one of the following:
- UBB.Classic (UBB.threads is NOT banned)
- Ikonboard
- YaBB / YaBB SE
- Proxy scripts
- Scripts that act as an alternative to SSH or Telnet
- Scripts that generate a large number flatfiles.
You will be better off using a forum that uses a database rather than flatfiles, such as Invision Board, XMB, or phpBB.
IISNet Networks is not responsible for any scripts that you use. We do not support any scripts, due to the fact that there are a tremendous amount of scripts out in the market. Our support team cannot provide support due to this reason.
7. Bandwidth Usage Policy
IISNet Networks allows a large bandwidth for sites. However, there will be a surcharge if the account exceeds the bandwidth limit. Using a account as a mirror or file archive is discouraged, however, allowed - unless it affects the performance of the server.
8. Backups
It is the Client's responsibility to backup all files. No guarantees are made of any kind to the quality of any backups that may be made.
9. Technical Support
The Client should be familiar with web hosting services beforehand, and have a fair amount of knowledge of the operation of their sites. Our support staff are not able to teach you completely how to operate your hosting account. Please refer to our forums for help, as there are many tutorials and How-To guides posted there.
We reserve the right to change the Terms of Service at any time without any notice. BY UPLOADING, SIGNING UP FOR ANY OF OUR PLANS, OR SUBMITTING ANY CONTENT TO IISNET NETWORKS YOU SIGNIFY YOUR AGREEMENT TO THESE TERMS.
